Strategies For Increasing The Value Of Settlement Offers In Motor Vehicle Accidents Cases
Posted by admin in Vehicle Accidents on January 19, 2011
Insurance companies handle thousands upon thousands of personal injury claims resulting from motor vehicle accidents each year. It is not uncommon for a victim of a motor vehicle accident to find that the offer made by the insurance company to settle their personal injury claim is significantly less than the apparent actual value of that claim. No doubt some of these low offers are the result of an honest error in the way an adjuster has valued the claim. But as attorneys who represent victims in motor vehicle accident cases know this happens with too much frequency to be due to simple error or miscalculation. Indeed, there appear to be two distinction situations in which such low settlement offers tend to be made. Below we examine each situation in order to try to understand the possible financial motivations that may lie behind deliberately making a low offer.
First, consider those claims that arise from injuries which resolve with treatment and which generally have a value that falls in the low end – say for no more than $20,000. For these claims it can be very tempting for the victim to accept a quick settlement offer even if it is a few thousand dollars below what the true value of the claim might be. The victim may decide that it is better to accept a low settlement offer today then wait three to four years to obtain the full value of the case. And the victim may decide that the difference is likely to not be substantial when the additional costs of litigation and trial together with the portion of the difference that will go toward attorney’s fees are taken into consideration.

Motor Vehicle Accidents – Distracted Driving, the New Drunk Driving
Posted by admin in Vehicle Accidents on January 19, 2011
When I was young, drunk driving did not have the stigma it has today. Police officers who pulled over a drunk driver would often follow the drunk driver home to make sure that they – the drunks! – made it home safely. I remember one incident that occurred in my home town when I was a kid. A gentleman who was known around town as a heavy drinker damaged his car while pulling out of a restaurant parking lot after “last call”. As a result, his car would only travel in reverse. He attempted to drive home from the restaurant in reverse. He was pulled over by a local cop who literally escorted this man to his driveway while the man drove drunk backwards. It became the talk of the town. A lot of people thought it was funny. The drunk driver was considered “a character”. This was in the late 60′s or early 70′s, and the designated driver didn’t exist. At that time, there was relatively little social stigma attached to drunk driving.
Due to the work of Mothers Against Drunk Driving and other similar organizations, all of that has changed. Drunk drivers are now almost universally seen for who and what they are – a menace to society who should be prosecuted, not protected, by law enforcement. Nobody thinks drunk driving is funny anymore.
